Traumatic Brain Injury or TBI

According to the Cleveland Clinic, a traumatic brain injury or TBI is "a serious medical issue that affects how your brain works." TBIs can be either penetrating, meaning something actually penetrates the skull, or blunt force/closed meaning someone hits their head but the skull remains in tact. Both can have very serious consequences.

TBI cases are very complicated. For starters, science is just now starting to recognize the serious nature of these injuries. Someone "seeing stars" or having their "bell rung" is no longer brushed off as minor or something to laugh about. Additionally, there is growing evidence that TBIs often have delayed onset symptoms, meaning someone may feel fine for a few hours, days, or weeks, and then start experiencing problems later on. Additionally, there is also increasing evidence that someone with a past TBI is more susceptible and will experience worse symptoms than someone with no prior TBIs. In other words, someone with a prior TBI is more vulnerable to a future TBI.

TBI symptoms vary, but they often include things like irritability, confusion and difficulty concentrating, memory loss, dizziness, ear ringing, behavioral changes, and headaches.

Is a concussion a traumatic brain injury?

Yes. People often associate a concussion as being "minor" whereas a traumatic brain injury is "major" or "serious." But the reality is that a concussion is a traumatic brain injury. And concussions are serious!

According to the Mayo Clinic, a "concussion is a mild traumatic brain injury that affects brain function. Effects are often short term and can include headaches and trouble with concentration, memory, balance, mood and sleep."

One of the things that can be tricky with concussion cases is that people often have concussions in their past medical history at some point. These are usually associated with past experiences playing sports. Sometimes, Defendants try to minimize a current concussion (e.g., one caused in a car wreck as an adult) because a person had a past concussion and recovered just fine (e.g., from playing football in high school). But that totally overlooks the complex nature of TBIs, which are discussed above.

Because these cases can be so complicated, it is important to have a firm with experience that you can trust, like Cronauer Law. Our Austin traumatic brain injury lawyer is ready to review your case and see if we can help.
