Historically, someone could only bring a lawsuit (or be sued) if they were alive. If the person died, there was no lawsuit. This resulted in tremendous injustice, both (1) for people who had a lawsuit pending and then died, and (2) for people who were killed by negligent or wrongful conduct.
Many (if not all) the states in America have corrected this through laws. Texas has Civil Practice and Remedies Code, Chapter 71.
